USPTO Increases Trademark and TTAB Fees

Effective January 2, 2021, the United States Patent and Trademark Office (USPTO) increased fees in trademark matters and changed some of its procedural rules.


New Trademark Fees:

  • Trademark applications using TEAS Standard increased to $350 per class (up from $275)

  • Section 8 renewal affidavit increased to $225 per class (up from $125)

  • Petitions to the director increased to $250 (up from $150)

  • Petitions to revive an abandoned application increased to $150 (up from $100)

The PTO added a new fee of $100 to delete goods, services or classes from a registration if the request is made after the renewal is filed, but before it is accepted. There is no fee if the request is made before the renewal declaration is filed or they are excluded from the renewal declaration. The PTO also codified procedures for letters of protest and imposed a $50 fee.


New Trademark Trial and Appeal Board Fees:

  • TTAB petitions for cancellation and opposition increased to $600 (up from $400)

  • Initial 90-day extensions of time to cancel or oppose increased to $200 (up from $100)

  • Final 60-day extensions of time to cancel or oppose increased to $400 (up from $200)
